Is It Legal to Swear at a Police Officer in the UK?

The parents have started watching Blue Bloods with Tom Selleck. They're amazed at the things that get people arrested and charged. They've asked for their own "Is it legal to swear at the Police in the UK?". I've asked them to take a guess... They think you won't get arrested if you swear at a police officer...

Is It Legal to Swear at a Police Officer in the UK?

Simply put, swearing at a police officer is not typically illegal. However, it's not a straightforward matter.

The Legal Context

The legality hinges on the context and manner of the swearing. If your language is seen as a form of disorderly behaviour, it could fall under the Public Order Act 1986. This Act makes it an offence to use threatening or abusive words or behaviour likely to cause harassment, alarm, or distress. So, the key here is the impact your words have on others, including the officer and the public.

But, there's a twist.

The law recognises the need for police officers to endure a certain level of robust language. This means not every swear word directed at an officer is automatically illegal. Context matters greatly.

For instance, swearing out of frustration or during a heated conversation might not be seen as an offence, we don't have any Danny Regan's here.  However, if your language is aggressive or intended to provoke a reaction, that's a different story. If you lose control and start swearing at anyone and everyone, including police officers, you've stepped out of frustration and into disorderly behaviour.
